Republic of Texas Harris County Know all men by these present that I Thomas M League of said county have this day for & in consideration of the sum of thirty dollars to me in hand paid bargained & sold to Thomas M Bagby his heirs & assigns all of the right title & claim which I have by virtue of the within deed to the lot and improvements herein conveyed to me by Magnus T. Rodgers, Sheriff of Harris County, in the Republic of Texas, of the one part, and Thomas M. League ----, of the County of Harris, of the other part, witnesseth: That whereas the said Magnus T. Rodgers, as Sheriff as aforesaid, and as such, being the Collector of Public Taxes, by virtue of an Execution issued by John Fitzgerald, a Justice of the peace, against the Estate of Edmund Osborn ---- for his Taxes for the year 1840, being for the sum of Forty five dollars ---, the amount of taxation, besides costs, dated on the 17th day of September, 1841, having levied on the property, the tax for which was outstanding and delinquent as aforesaid, and having given due notice of the day and place of the sale thereof, or of a sufficiency thereof to satisfy said execution, on the 27th day of November, 1841, at the Court House in the said County of Harris, did proceed to sell out of said property by public outcry, to the best bidder, for lawful money: and at such sale the said T. M. League became the highest bidder for the following property, namely: Lot Number Six in Block Number Forty three & the improvements in the City of Houston – and he having bid therefor [sic] and promptly paid the sum of Forty five Dollars Tax & five 75/100 dollars cost being the amount due and collectable on said execution: Therefore, the said Magnus T. Rodgers, as Sheriff and Collector, as aforesaid, in consideration of the premises and in conformity to the laws, does hereby grant, alien and convey to the said T. M. League, and his heirs, the said Lots so purchased by him, and herein above described and intended to be conveyed, warrant-ing the same only in mode and to the extent in and to which he, as such officer, by virtue of the premises and the laws in such case, is required to do, but no further: and this conveyance is to be recorded only after the period limited by law, and is subject to be rendered inoperative and extinct, provided the property so sold shall be redeemed by the owner according to the laws in such case provided. Culp Deputy clerk of Harris County Court, this day came John Fitzgerald who upon oath declared that Magnus T. Rodgers in his official capacity of Sheriff of Harris County, executed this deed of conveyance in his presence, as he acknowledged for the purposes and uses in the same expressed, and that he, depossesed, signed the same by request as a witness, Done in the City of Houston January 18th AD 1843.
